SCHWARTZ ROLLINS RECOVERS NEARLY $700,000 FOR PREGNANCY DISCRIMINATION AND FMLA VIOLATIONS ON BEHALF OF A FIRED LAWYER

Schwartz Rollins obtained a settlement of approximately $685,000 against the former District Attorney of the Cobb Judicial Circuit, Patrick Head, and his successor on behalf of Bonnie Shaw, a former Assistant District Attorney. The settlement was reported in the Atlanta Journal-Constitution on October 24, 2016. The case arose when Ms. Shaw filed a suit for sex and pregnancy discrimination, retaliation and violations of the FMLA and the U.S. Constitution in December of 2012.

In the suit, Ms. Shaw alleged that on November 10, 2010, eleven days after she notified the then District Attorney, Patrick Head, that she was pregnant and intended to take family leave for the birth of her child, she was pulled into a meeting with Mr. Head and Deputy Chief, Jesse Evans, and told for the first time that her job performance was unacceptable on virtually every front, and placed on 90-days probation. Ms. Shaw was fired on March 18, 2011, shortly before she was to take maternity leave. After more than two years of litigation, the Defendants filed a Motion for Summary Judgment to get the case dismissed, but Northern District of Georgia Magistrate Judge Linda Walker determined that all the claims, except for retaliation, would be sent to a jury. The parties agreed to mediate the case and a settlement was reached wherein the Office of the DA and the State of Georgia agreed to pay a total of $685,000 to Ms. Shaw and Schwartz Rollins.
